Section N: Terminations

1. No Documents Submitted by Anniversary Date

No Documents Submitted by Anniversary Date

  • At least 30 days prior to the anniversary date, forward a Contract Termination Notice (MSHDA 95) to the landlord and forward the Program Termination Notice (MSHDA 1634b) to the tenant.
    1. If the tenant does not request an informal hearing within 14 days, terminate the Contract as of the anniversary date.
    2. Submit a Case Data Summary to show EOP in the contract in Elite.
  • If the tenant requests a hearing, process the AR using the old income and new Contract Rent while awaiting the hearing decision.
2. Other Terminations

Terminations/EOP’s may also occur when:

  1. A tenant who began with a good faith effort did not complete the process;
  2. The unit ultimately does not pass HQS; or
  3. The landlord will not renew/continue participation.

Terminations require written notice to the tenant (MSHDA 1634b) and landlord (MSHDA 95) unless a Mutual Termination Agreement (MSHDA 96) has been executed. Cite the specific reasons why the tenant was terminated on the MSHDA 1634b.
