Section F: Consequences
Those who commit program abuses and/or fraud in connection with a federally-subsidized housing program are subject to a variety of penalties, including possible prosecution by state or federal authorities. Consequences specific to Program participants’ roles are noted as follows (in addition to possible state or federal prosecution):
- State Employees – will be subject to disciplinary action up to and including termination;
- Contracted Housing Agents – will be subject to contractual enforcement activity up to and including termination of their Contract with MSHDA;
- Landlords/Owners – will be subject to repayment of Housing Assistance Payments (HAP) for breach of the HAP Contract, termination of their HAP Contract, and denial of future participation in the Program;
- Tenants – will be subject to repayment of HAP or Utility Assistance Payments (UAP), termination of their HCV Assistance, and denial of future participation in the Program.
